MEETING NOT HELD

Meeting could not be called to Order for lack of a Quorum being present. Council members Chris Burch, Benny Combs, and PK Kirkpatrick (Mayor Pro Tem presiding at the meeting for Mayor Jan Cooper who was absent) were present. Amanda Adams and Cliff Isaacs were absent.

Tuesday, January 17, 2012
7:00 p.m. at Ladonia City Hall


I. Called to Order by Mayor Jan Cooper and Established a Quorum with Amanda Adams, Chris Burch, Benny Combs, Cliff Isaacs, and PK Kirkpatrick present.
II. Invocation was led by PK Kirkpatrick and the Pledges recited by all.
III. Visitors:
      1. Leon Hurse told the Council that there are three sites in the City where basketball goals are in the street, in the City right of way, creating a dangerous situation.

      2. Cliff Isaacs announced a donation jar is set up at Granny’s Place for Chennault family donations.

IV. Visitor Kenny Karl, candidate for Fannin County Commissioner in Precinct 3, was unable to attend. Mayor announced he has a website, www.electkennykarl.com, with good information about his experience and goals.

V. Approved the Minutes of December, 2011, with the addition of JRJ Street repair in the Public works report, by a motion from PK Kirkpatrick, a second from Amanda Adams and a vote of 5-0.

VI. Approved transactions and accounts payable for December, 2011 by a motion from PK Kirkpatrick, a second from Cliff Isaacs and a vote of 5-0. Cliff Isaacs wanted to note his comment that he would like to see a lower fuel bill.

VII. Reports

1. Police Department – PK Kirkpatrick read the report since Chief Mayberry was working the Game at the High School. There were 50 calls for service, 67 traffic stops, 24 citations, 43 warnings and eight call outs. There were 10 disturbance calls, nine follow-up reports, seven arrests, five suspicious activity, four each public intoxication, assaults, and agency assists, three each criminal trespass and animal complaints, two each theft calls, incidents, and code violations and one each welfare concern and civil. Councilman Kirkpatrick also read from the Annual Police Report that named $38,889 worth of equipment, upgrades, and supplies that were provided to the city at no cost to the City due to donations and municipal fine revenue. There were 464 calls for service and 37 arrests made during the last twelve months. The last year saw 212 incident calls responded to, 95 disturbance calls, 35 agency assists, 17 public intoxication and drug related calls, and 22 theft calls to which the police department responded.

2. Public Works Department – Shane Tarpley reported that the Blue water tower was successfully drained by our employees and repaired and serviced by National Tank Services. The older tower, the ‘Tin Man’, was determined to be functional after the employees did a tank inspection, although there are no pump sensors on the tower. Employees worked around the clock to manually monitor ‘Tin Man’ tower water levels, ensuring adequate water pressure for customers after an unprecedented drop in system pressure when the switch-over took place. Multiple water line leaks during the same day occurred. Three sewer clean-outs were jetted and extra maintenance to FM 64 lift station was performed. One man-hole on a 12 inch sewer line had the concrete and steel ring with lid replaced. One line locate was performed and no animals were picked up. The live trap was stolen from a location near Paris and Taylor streets where set with bait.

3. Volunteer Fire Department – Barry Berryhill read the Chief’s Report listing nine calls of which six were medical, one controlled burn, one fire, and one stranded cat. The water pump for the American LaFrance Pump Truck was repaired at a cost of $1,301.45; the engine now running. Some LVFD members attended and completed the FEMA ICS-200A Course which is one is a series of courses for National Incident Management program.

VIII. Council Presentations
1. Trade Day is January 21st on the square. Cliff Isaacs noted that every third Saturday in a month will be Trade Day. The fee is now $5 to set up.

IX. New Business

A. Discussed McCraw Chapel water supply request to tie in our water system with theirs for the purpose of selling them water. Harvey Milton, McCraw Chapel WSC Board President, gave a brief background on the history of McCraw Chapel WSC and their desire to be able to purchase water from Ladonia. Doug Franklin and Leon Hurse will addressed the Council with their knowledge of the benefits associated with being able to sell water to another entity and the timeliness of this issue with Lake Ralph Hall permits nearing completion. City Engineer David Perkins was available, answered questions, and told the Council this was a great idea for the City. PK Kirkpatrick moved to continue to pursue and obtain information necessary to make a final decision on the installation of a water line to tie in with McCraw Chapel’s lines. Amanda Adams seconded the motion and the motion carried 5-0.

B. Adopted Resolution 2012-01-09 setting the City General Election for May 12, 2012, the General Election set by the State by a motion from Cliff Isaacs, a second from Amanda Adams, and a vote of 5-0.

C. Appointed Julie Russell, City Secretary as Early Voting Clerk by a motion from PK Kirkpatrick, a second from Amanda Adams and a vote of 5-0.

D. Considered amending Code of Ordinances Article 11.100 Water System Regulations authorizing the collection of an extension or exception fee of $25.00 to water bills paid after the period of twenty days after the bill is mailed when the water supply is not shut off from the premises by exception granted from the Mayor. Cliff Isaacs moved to table the item until an ordinance amendment is written by the City attorney. Amanda Adams seconded the motion and motion carried 5-0.

E. Considered adopting Ordinance 2012-01-09 amending the City Code of Ordinances, Chapter 8, Article 8.200 City Clerk/Secretary/Treasurer, Section 8.211 City Council Minutes so that it reads “The city clerk shall attend all city council meetings and shall keep the minutes of the meeting”. Amanda Adams moved to table the item until the ordinance amendment is re-worded to include posting on City Hall bulletin boards inside and outside the building. PK Kirkpatrick seconded the motion and motion carried with a vote of 4-0 with Cliff Isaacs abstaining.

F. Approved the Ladonia Volunteer Fire Department election results naming Kyle Stark as the Fire Chief by a motion from Amanda Adams, a second from PK Kirkpatrick and vote of 5-0.

X. Old Business

A. Discussed quotes for estimate of repair of Water Well #2. Council had questions about one estimate and Shane Tarpley spoke with Steve Wooley, of Weisinger Company, over the phone to clarify. More questions about charges on each invoice arose and Cliff Isaacs questioned the difference in trip fees between the two companies. Amanda Adams moved to table the item and try to renegotiate the trip fee. Cliff Isaacs seconded the motion and motion carried 5-0.

B. Discussed possible methods to enforce City Ordinance violations of unrestrained dogs including suggestions form Amanda Adams, Cliff Isaacs, and PK Kirkpatrick. Mayor Cooper announced that Ladonia Housing Authority would pay $1,000 of the total annual fee of $6,120 if we contracted with North Texas Animal Control Authority. The city also received asset and forfeiture funds of $1,318 into the general fund to be available for use. Amanda Adams moved to have an open citizen forum one hour prior to the next regular meeting of the Council on February 6th at 6 pm so citizens can address the council with recommendations and ideas about the animal control problem of loose dogs. PK Kirkpatrick seconded the motion and the motion carried with a vote of 4-0 with Cliff Isaacs abstaining.

I. Called to Order by Mayor Jan Cooper at 7:00 pm and Established a Quorum of Amanda Adams, Chris Burch, Benny Combs, Cliff Isaacs, and PK Kirkpatrick.

II. Invocation was led by PK Kirkpatrick and the Pledges recited by all.

III. New Business

A. Adopted Resolution 2012-01-24 pledging support of the Chaparral Rails to Trails by providing labor and equipment to facilitate opening the 12.1 miles of the Trail in Fannin County for the purpose of an application to the Texas Park and Wildlife Department Recreational Trails Fund by Chaparral Rails to Trails by a motion from Amanda Adams, a second from PK Kirkpatrick and a vote of 4-1, Cliff Isaacs voting against.

IV. Old Business

A. Discussed quotes for estimate of repair of Water Well #2. Amanda Adams moved to table the item until more information and clarification could be obtained regarding the quotes. Cliff Isaacs seconded the motion and motion carried 5-0.

B. Adopted Ordinance 2012-01-09 amending the City Code of Ordinances, Chapter 8, Article 8.200 City Clerk/Secretary/ Treasurer, Section 8.211 City Council Minutes so that it reads “The city clerk shall attend all city council meetings and shall keep the minutes of the meeting and shall post the minutes both inside and outside City Hall on each bulletin board and on the City website in a timely matter” with the amendment of the Ordinance number to 2012-01-17 by a motion from PK Kirkpatrick, a second from Cliff Isaacs and a vote of 5-0.

V. Adjourned at 7:52 by a motion from Cliff Isaacs, a second from Amanda Adams and a vote of 5-0.
