I. Call to Order and Establish a Quorum
II. Roll Call: Janis Cooper, Lindon Warden, Amanda Adams, PK Kirkpatrick, Benny Combs, and Doug Franklin were present.
III. Invocation led by PK Kirkpatrick
IV. Visitors (limit 3 minutes)Keith Jackson said that loose dogs are a big problem.
V. Approved Minutes of January 3rd, January 17th and January 24th, 2011 with a motion from Doug Franklin, seconded by Amanda Adams, and carried 5-0.
VI. Approved Accounts Payable for January 2011 with the note that the name of the Survey Company (Clark R. Sanderson) be noted here in the minutes. PK Kirkpatrick also ordered a follow-up on ‘unknown phone line” 903-367-7021 to confirm if we need this phone line or can disconnect. With these notations in the minutes, Amanda Adams made a motion to approve the Accounts Payable, Lindon Warden seconded the motion, and motion carried 5-0..
VII. Administer the Oath of Office to Police Chief Kevin Mayberry
VIII. Reports
1. Police Department - Chief Mayberry reported 33 calls for service, 8 traffic stops, and 1315 miles driven. The Department has 15 cases working. Of the calls for service, 6 were disturbance calls, 5 were theft and burglary, 5 public intoxication calls, 3 accidents, 4 animal complaints, 2 phone harassment calls, and one (each) assault, criminal trespass, criminal mischief, welfare concern, arrest for warrant, and medical calls.
2. Publics Works Department - One of the new submersible lift station pumps created an electrical short and was sent back under warranty to the dealer in McKinney. We also have an issue with the other pump in that lift station, namely that the float relay for automatic operation is not working. Electricians will investigate when we get the repaired Pump. Water meters at each well were tested as required annually and were found to be within AWWA standards. We still have work orders for replacement of two shut-off valves, repairs to the sewer jetter machine and clean-up at Fossil Park.

3. Volunteer Fire Department - The Fire Department will be having Saturday Bingo games at 6:00 pm to raise money. John Ryder announced a class for 1st responders in Red Cross CPR for February 19, 9 am to 5 pm at a cost of $35 that is open to the public. He outlined the calls for January (11 total calls, 6 of which were medical, 2 accidents, and 1 each, controlled burn, structure fire, and grass fire.)
IX. New Business
A. Aadopted a resolution ordering a City Election on May 14, 2011 during the General Election set by the State, to elect three aldermen for two year terms by a motion from PK Kirkpatrick, seconded by Doug Franklin, carried 5-0.
1. Adopted a resolution setting the early voting place and voting place as City Hall by a motion from Amanda Adams, seconded by Benny Combs, carried 5-0.
2. Adopt a resolution naming two twelve hour days for early voting period as Tuesday May 3rd and Tuesday May 10th by a motion from Lindon Warden, seconded by Doug Franklin, and carried 5-0.
3. Approve a joint election agreement with Fannindel ISD by a motion from Doug Franklin, seconded by Lindon Warden, and carried 5-0.
4. Adopt a resolution naming the type and number of voting machines to be used, namely at least one Hart E/Slate DRE to be leased from Fannin County by a motion from PK Kirkpatrick, seconded by Benny Combs, and carried 5-0.
B. Assigned new signatures to the safety deposit box at Patriot Bank in Honey Grove. Doug Franklin moved to use the same signatories as designated for the bank accounts, PK Kirkpatrick seconded, was approved 5-0.
C. Approved the Ladonia Volunteer Fire Department amended By Laws , (1) providing for no upper age limit for volunteer, and (2) annual terms of office for officers other than the Chief and Asst. Chief, by a motion from PK Kirkpatrick, seconded by Amanda Adams, carried 5-0. .
D. Action regarding the City Emergency Siren was tabled by a motion from Lindon Warden, seconded by Doug Franklin, and carried 5-0.
E. Approve a Contractual Agreement between Kevin Mayberry and the City of Ladonia regarding his payments and debt liability for the New Police vehicle by a motion from PK Kirkpatrick, seconded by Amanda Adams, and carried with a vote of 4-1.

F. Consider, Action appointing a new Municipal Judge, Judge Skotnik, who also serves as Municipal Judge for the City of Bonham, as a rate of $250.00 per court session, by a motion from Amanda Adams, seconded by PK Kirkpatrick, and carried 5-0.
X. Old Business
A. Discuss research of the average cost of used ¾ ton pick-ups and air-bag overload springs to decide whether to advertise for bids or purchase a used ¾ ton pick-up truck for city use. PK Kirkpatrick suggested we find three or four representative trucks under $2,500 and present to Council again, Lindon Warden so moved, Doug Franklin seconded, the motion carried 5-0.
XI. Executive Session: Pursuant to Sec. 551.074 of the Government Code-Council may enter into closed or executive session to deliberate the appointment, employment, employment evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. Pursuant to Sec. 551.087 of the Government Code, deliberation regarding Economic Development Negotiations; CLOSED MEETING.
XII. The Council convened into open session at 8:57 pm and did not take action on matters discussed in closed session.
XIII. Meeting was recessed until 7:00 pm Tuesday, February 8, 2011 by a motion from PK Kirkpatrick, seconded by Amanda Adams, and carried 5-0.
XIV. Meeting was called to order at 7:02 pm on Tuesday February 8, 2011 and Amanda Adams, Janice Cooper, Benny Combs, Doug Franklin, PK Kirkpatrick, and Lindon Warden were present.
XV. Executive Session: Pursuant to Sec. 551.074 of the Government Code-Council may enter into closed or executive session to deliberate the appointment, employment, employment evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. Pursuant to Sec. 551.087 of the Government Code, deliberation regarding Economic Development Negotiations; CLOSED MEETING.
XVI. The Council convened into open session at 9:15 pm to take action on matters discussed in closed session. Mayor Cooper asked for a motion regarding the personnel matter and Lindon Warden moved to hire Shane Tarpley, beginning Monday, February 14th, as an employee in the water department with a 90 day probation period. PK Kirkpatrick seconded the motion, and motion carried 5-0.
XVII. Mayor called for further business. There being none, the meeting was adjourned.
