Minutes of Regular Meeting
Ladonia City Council
Monday, April 4, 2011
7:00 p.m. at Ladonia City Hall
I. Called to Order and Established a Quorum at 7:02 pm.
II. Roll Call: Janis Cooper, Amanda Adams, Benny Combs, Doug Franklin, PK Kirkpatrick, and Lindon Warden were all present.
III. Invocation was led by Doug Franklin and the Pledges recited by all.
IV. Visitors (limit 3 minutes)
1. Debra Scoggins expressed concern over the poor condition of Commerce St. and wanted to know when repairs are planned. Mayor informed her that as soon as the weather turned warm enough it would be patched with asphalt.
2. Cliff Isaacs informed the Council that a pothole on Main St. near the school had been filled with rock instead of asphalt. He also gave a report of lights out on the square.
3. Connie Wilburn reported that Richard St. beside the High School is dusty and full of potholes. Also that the culvert closest to the Ag building is washed out and there is a drop off.
V. By a motion from Doug Franklin, seconded by PK Kirkpatrick, approved the Minutes of March, 2011 as amended with the additions on item VII. 2. Reports - Public Works of the word “City Hall” to the sentence describing the roof leak and “in the Council Meeting room” to the end of the same sentence. Motion carried 5-0.
VI. Amanda Adams moved to approve transactions and accounts payable for March, 2011. Lindon Warden seconded the motion and motion carried 5-0.
VII. Reports
1. Police Department – Kevin Mayberry reported 31 calls for service, made 11 traffic stops, issued 12 citations and 9 warnings. He obtained several computers through a donation program and expects to get in the near future a power point presenter, a television and projection screen and a few laptop computers through this same program. He told the Council that a Court software program is being written for the City as a pilot program and should be ready in 4 to 6 weeks. He reported giving a class for the Volunteer Fire Department. He asked the Council to be aware that the City Ordinances should be updated to include a Dance Hall ordinance since there is one operating in town. He suggested that the ordinance include a permit fee, security on premises, hours of operation, and rules about conduct and alcoholic beverages.
2. Volunteer Fire Department – John Ryder reported 8 calls, mostly controlled burns. The area, he said, is under a red flag alert. Miscellaneous truck repairs continue. Several windows were donated of which they have installed one. Chief Ryder thought the class taught by Chief Mayberry was informative and helpful. The Fire Department will be hosting two classes soon, one in radio communication. Since the siren is working, John will confer with the Mayor to development a plan, policy and procedure for its use.
3. Public Works Department – The public works report was read by the Mayor. Mower and city truck both had maintenance. Police car had two rear tires replaced. Highway 64 lift station is working perfectly, and the sewer lagoons were cleared of brush and are working properly. Mowing was done at both water wells and the sewer plant (mostly cleared with a controlled burn assisted by the LVFD). Two dogs were picked up, one with puppies, and she was transported to the Commerce Animal Shelter. A local residence gave a home to the other dog. Disposal of two dead wild animals (one hog, one opossum) by City workers. Repairs to the City Hall roof in the Council meeting room will commence as soon as we have two more estimates. Municipal Court was held March 31st. $1085 in fines was collected in March and payments are still coming. We have people required to perform community service in excess of 60 hours. There are five more cases pending.

VIII. Council Presentations
A. Meet the Candidate Night – April 11th City Hall Meeting Room 7 pm
B. April Events:
1. Friday April 8th, L. C. Gardens Presentation and Ribbon Cutting. Dr Webber of the USDA will be bringing numerous plantings as a gift, Amanda Adams announced. She also made it known that some plots were still available for adoption.
2. Saturday April 9th Chuck Wagon Breakfast at Volunteer Fire Department begins at 8:30 am.
3. Saturday April 9th the second annual Rescue Run, Sponsored by Cooper Volunteer Fire Department, has a stop at Fat Boy’s BBQ around 10:30am.
4. Saturday April 16th Spring Fling with Easter egg hunt, blood mobile, Ribbon Cutting for the Repeater Antenna. Mayor Cooper pointed out the special Crock Pot Chili Cook Off which is not only a fund raiser for the Chamber of Commerce, but awards a money prize to the winners. Applications are available at City Hall.
5. City-Wide Clean up is currently under operation through April 9th. Dumpsters located South of the Square off of Depot St. Amanda Adams asked that restriction items list be posted on the dumpster itself.
C. Thanks to Rita Isaacs and Lavonne Duncan for flowers on the square, and to Cliff Isaacs for monitoring the lights on the square. There are issues with the lighting that are being addressed.
IX. New Business
A. Lindon Warden moved to renew David Wallace’s lease on mobile home which expires May 7, 2011 for the same terms as current lease, Amanda Adams seconded the motion with the amendment that the lease contract state explicitly the requirement of the lessee to pay the electric utility bill shared by the City Barn, which has not been paid by lessee under the current lease. Motion carried with a vote of 5-0.
B. Doug Franklin moved to begin the process of approving AT&Ts request to install 6 additional antennas, amplifiers, and associated coax, obtaining the requested information from the City engineers, and getting the structural designs from AT&T. Amanda Adams seconded the motion and motion carried with a vote of 5-0.
C. Approved adjusting water billing for City of Ladonia accounts, per auditors, to make two meters (acct# 523 and 319) ‘no charge’ and to force them to zero balance by a motion from Doug Franklin, seconded by PK Kirkpatrick, and carried with a vote of 5-0.
D. Approved contacting the owner of the property and discuss setting up new account for unmetered residence associated with acct# 319 (service address DIARY) by a motion from Doug Franklin, Seconded by Amanda Adams and carried with a vote of 5-0.
E. PK Kirkpatrick moved to obtain legal advice and possibly take legal action regarding the now disconnected Birch phone line 367-7021. Benny Combs seconded the motion and motion carried with a vote of 5-0.
F. Motion made by PK Kirkpatrick to increase by .84% due to inflation, as measured by the CPI, pursuant to Chapter 283 of the Local Government Code (House Bill 1777), the City’s maximum access line rate (telecommunications right-of-way access fee remitted to the City), seconded by Amanda Adams, and carried with a vote of 5-0.
X. Old Business
A. PK Kirkpatrick made a motion to grant the Mayor the authority to make the purchase of a truck or accept the donation of a truck, and for Councilman Benny Combs to provide information on donated trucks to the Mayor. Amanda Adams seconded the motion, and motion carried 5-0.
B. PK Kirkpatrick moved to table the discussion of demolition of substandard structures until more information is obtained. Lindon Warden seconded the motion and motion carried 5-0.
XI. Council did not enter Executive Session: Pursuant to Sec. 551.074 (Personnel) or Sec. 551.087 (Economic Development) of the Government Code.
XII. Adjournment motion made by Amanda Adams. The meeting adjourned at 8:24 pm.
